Annual Pass TERMS & CONDITIONS
PRINCIPAL TERMS
1. This agreement commences once you have made payment or have indicated your acceptance by checking the checkbox on the web sign up process. Even if the checkbox is not checked, your first membership payment constitutes your acceptance of this agreement.
2. This agreement will become binding between you as an individual and E60 Fitness Studios LLC d/b/a E60 Fitness.
3. You will be entitled to all privileges available for the type of plan chosen, once applicable fees and charges have been paid in full (See Fees and Charges).
4. You cannot transfer this agreement to anyone else.
FEES AND CHARGES
1. The plan's fees are collected from you by us via the payment method you have chosen on at checkout and are not refundable under any circumstances.
2. You agree to advise us immediately of any change to the Members Details provided.
3. If you make a class reservation and do not attend or cancel your registration within 2 hours of the class's start time, a $12 fee will be charged to your account.
4. A $20 one-time charge is applied if you choose to freeze your pass. Your pass can be frozen for a maximum of 6 months. After the 6 month duration, or reduced duration if requested, your pass will automatically be un-frozen.
7. There is no initiation fee associated with this plan. THIS CLUB IS NOT PERMITTED, PURSUANT TO THE VIRGINIA HEALTH CLUB ACT, TO
ACCEPT ANY INITIATION FEE IN EXCESS OF $125 OR ANY PAYMENT FOR MORE THAN THE
PRORATED MONTHLY FEE FOR THE MONTH WHEN THE CONTRACT IS INITIALLY
EXECUTED PLUS ONE FULL MONTH IN ADVANCE.
NO REFUNDS OR MONEY BACK
1. You are entitled to cancel your pass at any time but are not entitled to receiving any portion of the purchase price refunded.
2. You are responsible for monitoring and managing your membership. E60 Fitness assumes no responsibility for plans that were not fully or properly set on hold.GENERAL TERMS & CONDITIONS
MISCELLANEOUS TERMS
1. Members must be 18 or older (or 14 with a legal guardian signing a waiver of liability).
2. You agree to comply with the Rules of Membership, Facility Rules, and Class Registration Policies which are displayed in various areas relating to opening hours, scheduling of classes, use of facilities and your conduct. We may make reasonable changes to these Rules at any time.
3. If we take no action or let you off any breach of this agreement or give you extra time to pay or comply, it will not stop us enforcing the terms of this agreement strictly at a future date.
4. We may assign the benefit of this agreement and our rights thereunder to a third party on notice to you. Your rights under this agreement will not be prejudiced.
5. There may be occasions where we have to close all, or part of, the gym of which you are attending. We will do our best to let you know of such closures in advance of them taking place, unless the problem is urgent or an emergency. We will use all commercially reasonable measures to ensure that such closures are outside of peak visiting hours and are kept to a minimum, in both duration and frequency. You will not be entitled to a refund of part of, or all of, your membership fees in such circumstances.
6. We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these terms that is caused by any event that is outside of our reasonable control.
7. This agreement is governed by United States Federal Law and regulated by the Virginia Department of Agriculture and Consumer Services, which regulates health clubs in the Commonwealth pursuant to the provisions of the Virginia Health Club Act.
8. We may terminate this agreement with immediate effect on notifying you if you are in breach of the Clubs Rules.
9. The buyer of this plan should attempt to resolve any complaint the buyer has with the health club, E60 Fitness Studios LLC.INFORMATION ABOUT US
1. We are a registered LLC in Virginia, operating under the name E60 Fitness Studios, LLC.
2. We have two locations at: 1524 Clarendon Blvd, Arlington, VA 22209 and 3464 Berkeley Street, Alexandria, VA 22302.

YOUR PERSONAL INFORMATION
1. We will use the personal information you provide to us to:
(a) provide your plan services;
(b) process your plan payment; and
(c) inform you about similar products or services that we, or selected third parties provide, but you may stop receiving these at any time by contacting us.
2. We will not give your personal data to any third party.
3. We may use visual media (photos and videos) of you on our website, social media, newsletters, or other marketing platforms, unless otherwise notified.
PROMOTION TERMS
1. Promotional codes for pre-sales prices are valid until the date specified in the promotion and will not be honored after that date.
2. Future promotional pricing for new members has no bearing on existing membership prices and plans.
3. Any prizes offered by E60 Fitness must be claimed within 21 Days of announcement of the winners.
4. All Gym challenges are subject to fair play which is managed in club. Any recorded reps or times must be verified and signed off by a E60 Fitness team member.
